Input on the Draft Government Regulation on the Implementation of Law Number 11 of 2020 concerning Job Creation in the Forestry Sector
The draft government regulation (RPP) has the potential to increase deforestation by changing forest classifications and allowing Production Forest (HPT) to be released from forest area status. This threatens Indonesia’s Nationally Determined Contribution (NDC) targets in the forestry sector, given that HPT still contains extensive natural forest cover.
The removal of the “inventory and settlement of third-party rights” stage in forest boundary demarcation for “strategic areas” could significantly increase conflicts with Indigenous peoples and local communities living within and around forest areas.
The RPP is also seen as weakening evidence-based decision-making by changing the phrase “based on” to “considering” Integrated Research findings. Additionally, the removal of strict liability provisions for forest fires may undermine effective law enforcement.
