Legal Opinion On The Issuance Of Ministerial Regulation No. 11 Of 2020 Concerning Community Plantation Forests
Minister of Environment and Forestry Regulation No. P.11/2020 removes individuals from the list of applicants for Community Timber Plantation Forest (IUPHHK-HTR), requiring communities to apply collectively. The permit duration has been extended from 35 years to 60 years, with one possible extension of 35 years and evaluations conducted every five years.
The regulation also sets maximum area limits for HTR applications. For Forest Farmer Groups (KTH) or Federations of Forest Farmer Groups (GAPOKTAN), the maximum is 15 hectares per household or up to 5,000 hectares per business permit. For Forest Farmer Cooperatives (KOPTANHUT), the maximum area is 5,000 hectares.
The regulation strengthens peat forest protection through the designation of Protected Area Criteria (Criterion 2) and special provisions for peat areas that have already been licensed. For peat dome peaks that were previously permitted, plantations may only be harvested for one rotation cycle, after which ecological restoration is mandatory.
