Update Report on the Draft Presidential Instruction for the Postponement and Evaluation of Oil Palm Plantation Permits and Increasing Oil Palm Plantation Productivity

The draft Presidential Instruction circulated in December 2017 was a key follow-up to the palm oil moratorium announced by President Jokowi in April 2016. The draft contains 13 articles regulating the roles of eight ministries/institutions, with primary coordination under a Working Team under the Coordinating Ministry for Economic Affairs. While CSOs pushed for its immediate issuance, they highlighted the unclear validity period and requested a performance-based moratorium, rather than a simple three-year time limit.

The draft's substance includes a moratorium on new permits and an evaluation of existing permits, extending beyond the 2011 moratorium. Its main focus is the postponement of forest area release for palm oil, verification of permits and maps, and synchronization with the One Map Policy. CSOs also demanded an expansion of the moratorium's scope, transparency within the Working Team, performance-based restrictions, and the removal of exception clauses deemed to open legal loopholes."
