Distribution of Palm Oil Moratorium Authority

Implementation of Presidential Instruction (Inpres) Number 8 of 2018 concerning the moratorium on palm oil involves various ministries and government agencies. This coordination includes data collection, licensing evaluation, and follow-up aimed at improving governance and improving palm oil productivity.
The inpres moratorium on palm oil gives a series of powers to eight ministries/institutions to make improvements. The eight ministries/agencies include the Regent or the Mayor, the Ministry of Environment and Forestry, the Ministry of Agriculture, the Ministry of Agrarian Affairs and Spatial Planning, the Governor, the Investment Coordinating Board, the Ministry of Home Affairs, and the Coordinating Ministry for Economic Affairs. The authority granted includes mapping; collection, preparation, and verification of data and maps; delays in permits; follow-up; coaching and supervision; and reporting to the president.
There are two categories of licensing that are set out in this inpres, namely postponed licensing and the licenses are evaluated. Delayed licensing includes the recommendation of oil palm plantation permits, Plantation Business Licenses (IUPs), new land clearing permits, release or exchange of areas, applications for new investment, and expansion of existing plantation permits. While the licenses evaluated are the release or exchange of the area, the Plantation Business License (IUP), the Plantation Business Sign Letter (STDUP), and the development of people's oil palm plantations.
Once the evaluation is carried out, four ministries/institutions can follow up on problematic permits. Regents and governors can revoke IUPs and STDUP located within the forest area. The Minister of Agrarian Affairs and Spatial Planning can stop the issuance of Business Rights (HGU) and restore areas derived from the release of forest areas. The Minister of Environment and Forestry can restore areas derived from the release of forest areas and make lawsuits or legal efforts on the use of illegal oil palm land. Finally, the Minister of Agriculture can set norms, standards, procedures, and criteria for IUP and STDUP.
